The ICC judge also considered the possibility that the said “confirmation of charges” hearing could be postponed.
“I would add that in accordance with Rule 1217 of the Rules of Procedure and Evidence, this date may be postponed by the chamber depending on the progress of the proceedings, either on its own motion or at the request of the prosecution or the defense,” the ICC judge added.
Earlier, she made it clear during the pre-trial that today’s hearing is only about the introduction of parties to the case and to answer three questions.
“The main purpose of this initial appearance is to answer three questions,” Judge Motoc said.
After FPRRD and his counsel, former ES Salvador Medialdea introduced themselves, Judge Motoc then ordered a court officer to read the charges against the former president.
Based on the information read by the court officer, there were two main charges against FPRRD.
“On 7 March of 2025, pre-trial chamber one concluded that there were reasonable grounds to believe that Mr. Duterte is criminally responsible pursuant to Article 25 3 A of the Rome Statute; has knowledge and direct co-perpetrator for the crimes against humanity of murder, pursuant to Article 7 1 A of the Statute as follow:
A. Murder of at least 19 persons, allegedly drug pushers or thieves killed by members of the Davao Death Squad in various locations in or around Davao City, Philippines, between 2011 and 2016.
