ICC, inutusan prosecution agad ipaalam kay FPRRD kung may ebidensya na “favorable” sa dating pangulo

- Judge Iulia Antoanella Motoc of the International Criminal Court has ordered the prosecution panel to disclose all evidence it had to former president Rodrigo Duterte

- The ICC presiding judge in the said case also ordered the prosecution to immediately inform FPRRD of any evidences that could favor the accused

- In a video shared by ABS-CBN on socmed, one can see the ICC holding its pre-trial on the case involving the former president

- It can be recalled that FPRRD has been arrested on charges of crimes against humanity in relation to his bloody drug war

The International Criminal Court’s Judge Iulia Antoanella Motoc has ordered the prosecution to disclose all of its evidences against former president Rodrigo Duterte to the latter’s defense team.

Judge Motoc, who is also acting as the presiding judge in the said case also ordered the prosecution panel to immediately inform the defense team of FPRRD of any evidence deemed favorable to him so they can use it in his case and argument for possible interim release.

“In addition to any other disclosure provided for in the statute, the prosecution must disclose to you, as soon as practicable, evidence in his possession or at his disposal that show or tends to show your innocence to mitigate your guilt, or could undermine the credibility of the evidence against you,” Judge Motoc said.
“At the confirmation hearing you can contest the charges, challenge the evidence presented by the prosecutor, and present evidence. There will be no trial if the charges are not confirmed, or if the proceedings against you are completed,” she further said.

ICC’s Judge Motoc also told FPRRD that there is a possibility that he can be released on the interim pending his trial.

“You have the possibility to make an application for interim release pending trial. and finally Mr. Duterte, you have the right to be informed as soon as possible and in detail, of the nature, cause, and content of the charges in a language you fully understand and speak,” Judge Motoc said.

In a video shared by ABS-CBN on YouTube, one can see the ICC holding its pre-trial on the case involving the former president at The Hague in Netherlands.

In the beginning of the said pre-trial, Judge Motoc reminded everyone that the hearing is “neither the start of the trial, nor the confirmation of charges hearing.”

She also said that there will be no presentation or collection of evidence, meaning the issue as to whether FPRRD is guilty or innocent will not be addressed at this time.

“Today's hearing is neither the start of the trial, nor the confirmation of charges hearing. During today's hearing, no evidence will be collected or presented. And the issues of Mr. Duterte's guilt or innocence will therefore not be addressed,” Judge Motoc said.

The ICC judge then said that the purpose of the initial hearing is just to answer three questions, which are whether FPRD was informed of the crimes he’s accused of, whether he’s been informed of his rights under the Rome Statute, and the setting of the date of the next hearing.

Recently, former president Rodrigo Roa Duterte made his first appearance in the initial hearing conducted by the International Criminal Court. The presiding judge, Iulia Antoanella Motoc, said the main purpose of the initial hearing is to answer three questions. Two of the questions was whether FPRRD “has been informed of the crimes of which he is accused” and whether he “has been informed of his rights as recognized by the Rome Statue.” Former Executive Secretary Salvador Medialdea appeared as counsel for the former president.

Meanwhile back home, the Supreme Court en banc has issued an order directing several government officials to justify their actions in relation to the enforcement of an ICC warrant against former president Rodrigo Duterte. The High Court’s order, which was released March 13, 2025, ordered ES Lucas Bersamin, SILG JonVic Remulla Jr, and CPNP P/MajGen Rommel Marbil, to show casue within 24 hours. The court also said that the 24 hour window, which starts from receipt of notice, is “non-extendible.” It can be recalled that Duterte siblings Paolo, Sebastian, and Veronica filed a petition for “Writ of Habeas Corpus” in relation to the arrest and detention of their father, former president Rodrigo Duterte.
