The court is currently operating with four empty seats: Senator Loren Legarda remains on an extended medical leave abroad, Senator Ronald dela Rosa is reportedly evading an international arrest warrant, while Senator Rodante Marcoleta and Senator Jinggoy Estrada are both detained due to separate plunder charges.

With only 20 active members left, requiring 16 votes would demand a near-impossible consensus.

To navigate this constitutional maze, the chamber invited legal experts to serve as friends of the court.

According to comprehensive reports from GMA News and Rappler, retired Supreme Court Chief Justices Panganiban, Puno, and Davide strongly argued that the voting threshold should only be based on the number of lawmakers actively participating in the trial.

Offering a contrasting view, retired Associate Justice Adolfo Azcuna, who helped frame the 1987 Constitution, maintained that the exact wording strictly refers to the entire roster.

Despite this, after both the prosecution and defense panels were given 15 minutes each to present their oral arguments this Wednesday, the chamber ultimately voted via voice vote to lower the threshold.

Prior to the decisive vote, impeachment court spokesperson Atty. Reginald Tongol assured the public that the body was handling the debate with absolute care.

“The Impeachment Court will not rush the resolution of this constitutional threshold. Doctrinal accuracy and constitutional exactitude take precedence over speed,” Atty. Tongol stated.

With the voting threshold now officially reduced by the participating members, the impeachment trial is expected to proceed directly to the presentation of critical evidence and witness testimonies in the coming days.
