On the morning of Tuesday, September 22, the embattled worker, backed by strong legal support, filed a formal motion for reconsideration and a motion for inhibition before the Makati Prosecutor's Office.
This bold legal maneuver comes after prosecutors initially cleared the three prominent celebrities of slight illegal detention, maltreatment, and unlawful arrest due to an alleged lack of evidence.

Led by lawyer Argel Joseph Cabatbat of the Volunteers Against Crime and Corruption (VACC), the complainant's camp firmly believes that the investigating body showed partiality and committed a grave error in junking the highly controversial case.
The most shocking revelation in their appeal points directly to a police blotter report where Michelle herself allegedly admitted that her former employee "made an attempt on his escape," and was subsequently "caught and brought back to my unit."
The driver's camp aggressively questioned this specific detail, asking why Bonifacio had to escape and be forcibly retrieved if he was genuinely free to leave the premises.
Furthermore, they argued that the prosecutors conveniently ignored authenticated CCTV footage from the National Bureau of Investigation (NBI) and vital witness testimonies that corroborated the harrowing ordeal.
Because of this alleged bias, the legal team is now demanding the voluntary inhibition of Senior Assistant City Prosecutor Mikhail Maverick P. Tumacder, Division Chief Melvin A. Matti, and City Prosecutor Dindo G. Venturanza from handling the subsequent proceedings.
Meanwhile, the legal counsel of Michelle, Atty. Maggie Abraham-Garduque, briefly stated that they are simply waiting for their official copy of the motion before filing a formal opposition.
VACC President Arsenio "Boy" Evangelista stressed that they are only asking for a fair fight for the ordinary worker.
“Hindi namin hinihingi na agad paniwalaan si Totoy. Hindi rin namin hinihingi na agad husgahan ang mga respondents. Ang hinihingi namin ay huwag balewalain ang ebidensya,” the anti-crime group passionately declared.
The highly publicized legal dispute initially stemmed from an intense incident in January when Bonifacio formally sought the assistance of the NBI.
He officially accused his former employer and the two beauty queens of illegally detaining him inside a Makati City condominium.
The confrontation allegedly occurred after he was accused of taking a red envelope containing sensitive photographs.
Following his initial report, the NBI conducted a thorough investigation and case build-up, which eventually led to the formal lodging of complaints before the Makati prosecutors in May.
