TVJ, pinanigan ng korte sa reklamo laban sa TAPE at GMA ukol sa “EB” at “Eat Bulaga”

- Tito Sotto, Vic Sotto, and Joey De Leon, collectively known as “TVJ,” in a post on their social media page, shared the news that the court has granted their complaint against TAPE and GMA as to the use of trademarks “EB” and “Eat Bulaga”

- According to the post of the trio, after a court proceeding that lasted five months, TVJ emerged victorious in their complaint against TAPE and GMA-7

- They also shared that the court rendered its decision last December 22, 2023, and it was by TVJ’s lawyers today, January 5, 2024

- The post also revealed that the court has prohibited TAPE and GMA from using the said trademarks, including the jingle, thus paving the way for its use by TVJ in their noontime show at TV5

Tito Sotto, Vic Sotto, and Joey De Leon, more popularly known as “TVJ,” in a recent post on their Facebook page, shared the news that the court has granted their complaint against TAPE and GMA as to the use of the trademarks “EB” and “Eat Bulaga.”

According to the trio’s post, the court prohibited TAPE and GMA from using the said trademarks, including its jingle in any of their shows.

The decision appears to have paved the way for TVJ to use the “EB” and “Eat Bulaga” trademarks in their own noontime show at TV5.

“After a rigorous proceeding that lasted five months, TVJ emerged victorious in their copyright infringement and unfair competition case versus against Television and Production Exponents Inc. (TAPE) and GMA-7,” TVJ’s Facebook post read.

“In a Decision dated 22 December 2023, which was received by TVJ’s lawyers from DivinaLaw on January 5, 2024, the Regional Trial Court (RTC) Branch 273 of Marikina City granted TVJ’s Complaint against TAPE,” it further read.

“As such, the court prohibited TAPE and GMA from using the trademarks “EB” and “Eat Bulaga,” the Eat Bulaga jingle, from its shows,” TVJ’s post revealed.

The trio’s post went on to say that TVJ would now be able to use the two popular trademarks, including its jingle, in their own shows.

“With the court’s ruling, TVJ is now able to use the trademarks and jingles in its shows,” the post of TVJ said.

The trio also shared part of the dispositive portion of the court’s decision, particularly the one saying that the Marikina RTC Branch 273 found Joey De Leon was the creator of the “Eat Bulaga” trademark.

“In view of defendant TAPE's failure to make a categorical and specific denial of the claim of Joey that he coined, formulated, and worded the title Eat Bulaga including the specific explanation how such a portmanteau was created, given the millions of words in the dictionary,” the court decision as shared in TVJ’s post read.

“The court, therefore, rules that plaintiffs have successfully proved and established, by preponderance of evidence, that Joey and his co-plaintiffs Tito and Vic should be credited with the formulation and creation of the mark Eat Bulaga,” the court, in its decision, said.

TVJ then noted that under the Revised Rules of Procedure pertaining to Intellectual Property Rights disputes, “any order issued by the court is immediately executor.”

“This means that the RTC’s ruling will already be enforced even if TAPE or GMA files an appeal,” TVJ’s post read.

"Eat Bulaga" is the longest-running noontime variety program on Philippine television. The show premiered on July 30, 1979. Its pioneer hosts include showbiz icons Tito Sotto, Vic Sotto, and Joey de Leon.

In December 10 of last year, Tito Sotto, Vic Sotto, and Joey De Leon revealed they have filed an injunction at a Regional Trial Court in Marikina City. They made the legal move in order to stop TAPE, Inc from using the name "Eat Bulaga" in their noontime show. The trio further revealed then that if the court favors their complaint, they would be able to use the name "Eat Bulaga" on TV 5. It can be recalled that IPOPH recently granted the petition of TVJ regarding the issue of trademark.

A week before that, their post on their social media pages brought delight to the supporters of the “Legit Dabarkads.” In the post, the accounts of the legendary trio – Tito Sotto, Vic Sotto, and Joey de Leon – have now mentioned “Eat Bulaga.” It also contains photos of the trio and their co-hosts on TV5’s “E.A.T.” The post came after TVJ won the “Eat Bulaga” trademark dispute.
