A document from the International Criminal Court (ICC) has revealed that former President Rodrigo Duterte, currently detained on charges of crimes against humanity, had nine individuals who acted as co-perpetrators in the implementation of his controversial war on drug$.

A document released by the ICC, dated March 13, detailed the presence of these co-perpetrators, although their names were redacted.
The 54-page document stated, “His co-perpetrators included, each for at least part of the temporal period: [REDACTED]14 [REDACTED]15 [REDACTED]16 [REDACTED]; 17 [REDACTED]; 18 [REDACTED]; 19 [REDACTED]; 20 [REDACTED]; 21 [REDACTED]; 22 and other members of the Philippine National Police (“PNP”) and high ranking government officials (together, including DUTERTE: “the co-perpetrators”).”

Former presidential spokesperson Harry Roque has publicly speculated that Senator Ronald “Bato” Dela Rosa could be among the individuals listed, along with four other former Philippine National Police (PNP) chiefs whose identities he withheld.

Roque emphasized his role as legal counsel for these individuals, stating, “I will state for the record that even before the warrant of arrest was issued, I was already acting as counsel for Senator Bato and four other former PNP chiefs including—I will not mention their names anymore, okay—but four other PNP chiefs who could also be named as co-accused in this case.”
Roque also highlighted the use of the term “co-perpetrator,” noting its significance in the ICC's documentation.
“Remember, the term is co-perpetrator, which to me is also very intriguing because it is the first time I hear the designation as co-perpetrators… that is curious, that the warrant of arrest said he is a co-perpetrator. There could also be other co-perpetrators,” he added.
Dela Rosa has previously asserted that he has not received any arrest warrant from the ICC regarding his alleged involvement in the war on drug$.
Senate President Francis “Chiz” Escudero had suggested that Dela Rosa could seek sanctuary within the Senate.
However, ICC-accredited lawyer Joel Butuyan clarified that this would not be legally permissible due to the potential severity of the charges, which carry a minimum penalty of 30 years, exceeding the legal limit for sanctuary.
Official government data indicates that at least 6,000 individuals were killed during the war on drug$ under Duterte's administration.
However, human rights organizations and the ICC prosecutor estimate the death toll to be significantly higher, ranging from 12,000 to 30,000 between 2016 and 2019.
Duterte was arrested at Ninoy Aquino International Airport on March 12 and subsequently detained at Villamor Air Base. He has since been transferred to The Hague, where he is currently detained.

His pre-trial hearing took place on March 14, and his confirmation of charges hearing is scheduled for September 23, prior to which he may appeal for interim release.

He also revealed that Medialdea was able to visit FPRRD for about an hour and that the former president was in high spirits.

Meanwhile, in a previous announcement, Atty. Harry Roque will be seeking asylum in the Netherlands. The former presidential spokesperson himself made the declaration in a recent online press conference. He said that if his asylum status is approved, he cannot be deported to the Philippines. Atty. Roque also said that he cannot come home as he has to defend former president Rodrigo Duterte.
