Chief Presidential Legal Counsel Juan Ponce Enrile stated on Tuesday that former President Rodrigo Duterte’s legal troubles are not connected to Philippine laws and should not be attributed to the government.

The International Criminal Police Organization (Interpol) and local authorities served an arrest warrant issued by the ICC against Duterte for alleged crimes against humanity linked to his controversial war on dr&gs during his time as both mayor and president.

“The current legal problem of former President Rodrigo R. Duterte is not caused by Philippine laws. His legal problem is caused by laws enforceable by the International Criminal Court (ICC),” Enrile explained in a statement posted on social media, and shared by ABS-CBN.

The ICC has been investigating Duterte’s alleged involvement in extrajudicial killings both during his presidency and his tenure as mayor of Davao City.

These accusations have sparked international condemnation from human rights groups.

Enrile underscored that blaming the Philippine government for Duterte’s legal predicament would be incorrect, as the charges originate from the ICC rather than local legislation.

“It is not correct to blame the Philippine government for the current legal problem of ex-PRRD,” he emphasized.

He also advised Duterte’s legal team to secure official documentation of the charges from the ICC to understand the basis of the arrest warrant.

“His lawyers should endeavor to secure a copy of the ICC charges against him so that they will know why he was ordered to be arrested by the ICC,” Enrile stated.

“Philippine domestic laws have nothing to do with his current legal problem,” he added.

While the government has reiterated its refusal to cooperate with the ICC investigation, it acknowledged its responsibility to fulfill obligations under Interpol.

Former Pres. Rodrigo Duterte was the 16th President of the Republic of the Philippines. He left Malacañang on June 30. The newly inaugurated President of the Philippines is Bongbong Marcos who got 31 million votes in the May 2022 elections. The new Vice President of the Philippines is VP Sara Duterte, the daughter of former president Rodrigo Duterte.

Earlier, the former president was apprised of his rights under the Miranda Doctrine. In a video shared by GMA News, CIDG chief, Police Major General Nicolas Torre III, is seen reciting the Miranda Doctrine to the former president. The reading of the Miranda rights is a standard procedure for persons being arrested to ensure that the latter fully understands their rights upon their arrest. It can be recalled that the International Police (InterPol) has confirmed the issuance of the arrest warrant by the International Criminal Court against the former president.

An earlier video showing former President Rodrigo Duterte’s longtime partner, Honeylet Avanceña, seemingly trying to prevent the former leader from being taken into custody has gone viral. The video, which was posted on the social media page of their daughter, Veronica or Kitty Duterte and shared by ABS-CBN news on its own page, has since then gone viral. The said video also captured snippets of conversations between Avanceña and the former leader. As of this writing, the video has gained 1.2 million views with 5.4K comments and 29K reacts.
