A 38-year-old man has been sentenced to 20 years in prison by the Sandakan High Court in Sabah for causing the death of his pregnant wife during violent s&xual intercourse. The ruling was delivered on June 26.

Mohd Rusdi Mohd Nor, who is unemployed, was found guilty of unintentionally causing the death of Dr. Azma Ab Rajab, a six-month pregnant medical officer, on November 9, 2022, at their condominium in Jalan Utara, Inquirer reported
Justice Celestina Stuel Galid ruled that the prosecution had proven the case beyond reasonable doubt under Section 304(a) of the Penal Code, which pertains to causing death without intent to murder.
In her judgment, she noted the act was not premeditated and there was no history of prior domestic abuse.

Nonetheless, she emphasized the gravity of the consequences, pointing out that both the victim and her unborn child lost their lives.
During mitigation, the defense argued that Rusdi was remorseful, had fully cooperated with the police, and that the incident occurred spontaneously and without intent to kill.
The court was informed that although there were no signs of strangulation, injuries were found around Dr. Azma’s nose, mouth, and neck.
Deputy Public Prosecutor Risal Abd Fikkah stated that the cause of death was asphyxiation due to smothering, and that the victim likely struggled to survive.
He also paid tribute to the victim, saying Dr. Azma, an emergency doctor at Duchess of Kent Hospital, “spent her life saving others, yet died at the hands of her own husband.”
