FPRRD, maaring mag-file ng “application for interim release pending trial,” ayon sa ICC

- Judge Iulia Antoanella Motoc of the ICC informed former president Rodrigo Duterte that the latter can file for an “application for interim release pending trial”

- An “interim release pending trial” is a remedy provided by international criminal courts and tribunals for a detained accused

- According to the Oxford Public International Law, the release can be ordered by the judge who first determines whether conditions for the pre-trial detention of the accused are met

- Judge Motoc, during the ICC pre-trial, also said “there will be no trial if the charges are not confirmed”

This was made clear by International Criminal Court Judge Iulia Antoanella Motoc during the pre-trial appearance of the parties involved in the case.

“You have the possibility to make an application for interim release pending trial,” Judge Motoc said.

A quick look at the Oxford Public International Law website would give one an overview of what an “interim release pending trial” is.

“Interim release, or provisional release, in international criminal procedural law refers to the release of an accused who was detained by an international or internationalized criminal tribunal while the accused awaits the conclusion of their case. This release is ordered by a judge who controls whether the conditions for pre-trial detention are met,” the Oxford Public International Law website explains.

It can be recalled that FPRRD was ordered arrested by the ICC for crimes against humanity and brought to The Hague on March 11, 2025.

During the pre-trial, where FPRRD attended via a remote video link, the ICC informed the former president of the reason for his arrest and the crimes he was accused of.

During the pre-trial, Judge Motoc also told the former president and former ES Medialdea, who represents him at the tribunal as FPRRD’s legal counsel, that the defense panel can contest the charges and challenge the evidence presented by the prosecutor.

She also said there will be no trial if the “charges are not confirmed.”

“At the confirmation of charges hearing, you can contest the charges, challenge the evidence presented by the prosecutor and present evidence. There will be no trial if the charges are not confirmed or the proceedings against you are completed,” the ICC presiding judge said.
“And finally Mr. Duterte, you have the right to be informed as soon as possible and in detail of the nature, cause and content of the charges in a language that you fully understand and speak,” she concluded.

Former Pres. Rodrigo Duterte was the 16th President of the Republic of the Philippines. He left Malacañang on June 30. The newly inaugurated President of the Philippines is Bongbong Marcos who got 31 million votes in the May 2022 elections. The new Vice President of the Philippines is VP Sara Duterte, the daughter of the former president.

Meanwhile, former executive secretary Salvador Medialdea, who appeared in the pre-trial hearing at the ICC chambers in The Hague, told the court that former president Rodrigo Duterte was allegedly a victim of “extrajudicial rendition,” or kidnapping. This was the firm assertion of the former executive secretary in a manifestation expressed during the ICC pre-trial hearing. He also said that the former president was transported to The Hague in a degrading fashion. FPRRD, represented by his lawyer, ES Medialdea, recently made his first appearance in the initial hearing conducted by the International Criminal Court.

During the pre-trial, Judge Iulia Antoanella Motoc of the International Criminal Court (ICC) set the next hearing of the case against former president Rodrigo Duterte on September 23, approximately 6 months from now. In a video shared by ANC Digital on socmed, Judge Motoc said that particular hearing will be about the “confirmation of charges.” Judge Motoc made it clear during the pre-trial that the recently-concluded hearing is primarily to introduce the parties to the case and to answer three questions. She also said that there will be no presentation or collection of evidence during pre-trial.
