In its 43-page ruling, the Division granted the Petition for Review on Certiorari filed by Vhong, which thereby ordered the dismissal of the charges of rape and acts of lasciviousness.

As per the decision of the Division, the CA erred in finding that the Department of Justice committed grave abuse of discretion amounting to lack or excess of jurisdiction when it dismissed the complaints of rape and attempted rape against the comedian.
