Utah County District Attorney Jeffrey Gray said his office filed seven counts in total, including obstruction of justice for disposing of evidence and witness tampering for ordering his roommate to delete texts.
Gray explained that his decision to pursue the death penalty was made based on the evidence and circumstances of the crime.
The attack was captured on video and widely shared online, sparking outrage and fears of more political violence.
No clear motive has been revealed. Supporters of Kirk described him as a martyr for their cause.
Kirk, 31, was the co-founder and leader of the conservative student group Turning Point USA and a close ally of former President Donald Trump.
Robinson, a student in an electrical apprenticeship program, managed to flee the scene but was arrested the following night at his parents’ home, 260 miles away.
Relatives and a family friend contacted police after he admitted involvement.
He was scheduled to appear in court via video from jail in Provo.
Utah Governor Spencer Cox said the state supports pursuing the death penalty, but prosecutors will also consider the wishes of Kirk’s family.
