The law office addressed the public on Sunday, February 1, 2026, to dispel "inaccurate and misleading" information. According to Atty. Cristobal Rimando, there is no valid warrant of arrest issued by any court against his client.

“We hereby clarify that our client, Mr. PSMS John Mollenido, is NOT under arrest,” the official statement read. “As of this time, no valid warrant of arrest has been issued by any competent court against him. Reports or statements suggesting that he has been arrested are inaccurate and misleading.”
The legal team explained that Mollenido’s presence with the authorities should not be viewed as a capture. Instead, they described it as a gesture of good faith and respect for the law.

“Our client voluntarily submitted himself and fully cooperated with the authorities in good faith. His appearance was an exercise of transparency and respect for due process and must not be misconstrued as an arrest,” the statement further explained.
The confusion started after reports circulated that Mollenido was taken into custody following the tragic deaths of his wife, Senior Master Sergeant Diane Marie Mollenido, and their eight-year-old son, John Ysmael. Mollenido was earlier tagged as a person of interest after one of the suspects in the case pointed to him as the person allegedly responsible for the killings.
Despite the heavy accusations, Mollenido's camp is standing firm on his right to due process. They continue to urge the public to wait for the results of the official investigation rather than relying on unverified claims.
The case began when PSMS Diane Marie Mollenido and her son went missing in mid-January. Their bodies were later found in separate locations—Diane in Bulacan and her son in Tarlac. The investigation has since led to the arrest of several suspects and the recovery of an SUV used in the crime. As a fellow police officer, John Mollenido’s involvement has been a major point of discussion in the media, leading to intense public scrutiny of his every move.
Earlier reports highlighted how a car agent, who is also a suspect, named John Mollenido as being involved in the double murder. This led to his decision to appear before the Quezon City Police District to clear his name. The car agent’s statement remains a primary piece of evidence being weighed by investigators as they seek justice for the Mollenido family.
A recent development in the case involved another suspect who surrendered and provided a detailed account of what happened on the night of the killings. The suspect's testimony has provided the police with a clearer timeline of the crime, from the initial meeting in Novaliches to the disposal of the bodies in Bulacan and Tarlac. This statement is currently being cross-referenced with other evidence found in the abandoned SUV.
