In the Philippines, if a driver loses control of a vehicle due to brake malfunction and it results in casualties, liability generally depends on the outcome of a formal investigation.
The key issue will be whether the driver or vehicle owner exercised due diligence in maintaining the vehicle. Under Philippine law, particularly Article 2180 of the Civil Code, vehicle owners and drivers can be held liable for damages caused by their negligence or the defective condition of their vehicle, even if the mechanical failure appears to be accidental.
If it is proven that the brakes failed because of poor maintenance, lack of regular inspection, or ignored warning signs, then the driver or owner could face criminal charges such as reckless imprudence resulting in hom!cide, physical injuries, or damage to property.
However, if it is clearly shown that the malfunction was unforeseeable and that all necessary precautions were taken beforehand, the driver may be absolved of criminal liability, though civil liability might still arise to compensate victims or their families. Ultimately, each case would be assessed based on the facts, including expert mechanical analysis, witness testimonies, and maintenance records.
