In a report by GMA 7's 'Balitanghali,' the rider reportedly slowed down a bit, resulting in the truck to hit the rider before totally falling down.
The 38-year-old victim was announced dead on the spot. Meanwhile, the truck driver is already in police custody. He refused to give any statement about the incident.
In the Philippines, if a driver accidentally hits and kills another motorist, the case is usually treated as "reckless imprudence resulting in hom!cide."
This is a criminal offense under the Revised Penal Code. The police will investigate the scene, gather evidence such as CCTV footage and witness statements, and determine whether there was negligence or violation of traffic rules.
The driver may be arrested, especially if found at fault, and charges can be filed in court.
However, in some cases, a settlement between the driver and the victim's family may happen. Even with a settlement, the criminal case may still proceed depending on the circumstances and the court's decision.
