In the Philippines, if someone sneaks into a store and steals money, the crime is typically classified as theft, and in some situations, it may be considered robbery, depending on how the act was carried out.
Theft, under Article 308 of the Revised Penal Code, happens when someone takes another person’s property without using violence, intimidation, or force. This means that if a person quietly enters a store and takes money without breaking in or threatening anyone, it is usually considered simple theft.
On the other hand, robbery, which falls under Articles 293 to 302 of the Revised Penal Code, involves taking property using force, intimidation, or by breaking into a building. If the suspect broke a lock, forced entry, or used any threats or weapons, it could be treated as robbery.
Penalties for theft depend on the value of what was taken. If the stolen amount is over ₱2,000, the offender could face prision correccional, which is from six months and one day to six years in prison. Robbery penalties are generally harsher, ranging from six years to over twenty years, depending on the severity of the crime.
In the case of someone quietly sneaking into a store and stealing ₱3,500 without violence or forced entry, it would most likely be treated as theft.
