The High Court's order, released on March 13, 2025, mandates that Executive Secretary Lucas Bersamin, Interior and Local Government Secretary Juan Victor Remulla Jr., and Philippine National Police Chief Major General Rommel Francisco Marbil “show cause within a non-extendible period of 24 hours from receipt of notice why the peremptory writ of habeas corpus should not issue.”

This order stems from consolidated petitions for habeas corpus, certiorari, and prohibition, filed by members of the Duterte family, specifically Representative Paolo Z. Duterte, Sebastian Z. Duterte, and Veronica A. Duterte.

The petitions challenge the government's role in enforcing the ICC warrant, seeking to nullify these actions and prevent further cooperation with the international body.

The core of the petitions centers on the assertion that the government's actions are unlawful and that former President Duterte's detention is unjust.

The petitioners are specifically invoking the writ of habeas corpus, a legal recourse used to challenge unlawful detention.

The Supreme Court's decision to consolidate the petitions and issue the “show cause” order indicates the gravity of the legal questions raised.

The 24-hour deadline underscores the urgency of the matter, suggesting that the court is treating the petitions with utmost seriousness.

The ICC warrant, which forms the backdrop of this legal battle, pertains to allegations of crimes against humanity related to Duterte's war on drug.

The ongoing legal proceedings have ignited debates about the Philippines' obligations to international legal bodies and the extent of executive authority in enforcing international warrants.

The “show cause” order requires the respondents to provide a detailed explanation of their legal basis for enforcing the ICC warrant and detaining Duterte.

This response will be crucial in determining whether the Supreme Court grants the writ of habeas corpus and potentially halts the government's cooperation with the ICC.

The Supreme Court's decision will have significant implications for the relationship between the Philippine government and the ICC.

It could also set a precedent for future cases involving international warrants and domestic legal procedures.

The public eagerly awaits the respondents' explanations and the Supreme Court's subsequent rulings.

The legal and political ramifications of this case are far-reaching, impacting both domestic and international legal frameworks.
