CA denies DNA test requested by Wenn Deramas' siblings and relatives be done on director's children

The Court of Appeals denied the petition filed by the relatives of late film director Wenn Deramas to subject his children, Gabriel and Raphaella, to DNA testing.

The case was related to disputes over properties and bank accounts.

In a decision dated September 8, the CA’s 15th Division said the petitioners were wrong to connect sexual orientation with the inability to have children.

The court added that a DNA test cannot be granted based only on weak and unsubstantial claims.

The court pointed out that Gabriel and Raphaella’s birth certificates state that Deramas is their father and Ariane Manalo is their mother.

These public documents carry strong legal weight and need strong evidence to be overturned.

The case covered two parcels of land in Quezon City, along with Deramas’ bank savings and checking accounts.

Petitioners, including Deramas’ sibling and nieces and nephews, filed the case after learning that the children had already transferred the assets under their names.

According to the CA, petitioners argued that Deramas did not legally adopt Gabriel and Raphaella, born in 2000 and 2010.

They also claimed that since Deramas was gay and Manalo was lesbian, they could not have sired the children.

Petitioners further said the two were never married.

Despite this, the court emphasized that birth certificates of the children are valid public documents.

It affirmed the earlier ruling of Quezon City Regional Trial Court, Branch 105, which denied the motion for DNA testing.

Wenn Deramas passed away in February 2016.
