Authorities said the driver of the van is already in police custody. The driver is facing charges related to the accident.
The tragic incident is a reminder of the risks faced by riders, especially when wearing loose clothing on the road.
If a motorist kills another motorist by accident, it is usually treated as a case of reckless imprudence resulting in homicide under Philippine law.
The driver is taken into police custody for investigation, and authorities will check if negligence, overspeeding, drunk driving, or other violations were involved.
Even if there was no intent to kill, the driver may still face criminal charges and civil liabilities to the victim’s family.
The court may impose penalties such as imprisonment, fines, or both, depending on the circumstances of the case.
In some situations, if the victim’s family agrees to a settlement, charges may be reduced or dismissed, but the legal process still requires proper investigation and documentation.
