According to the report, the authorities impounded the truck, and its driver is currently in the custody of the Mandaue traffic police.
In the Philippines, when a truck driver accidentally hits a motorcycle and causes the death of the backrider, the common legal case filed is Reckless Imprudence Resulting in Hom!cide under the Revised Penal Code.
Usually, the truck driver is detained by the police while an investigation takes place.
Charges are filed if there is proof of negligence, such as over-speeding, improper overtaking, or failure to follow traffic rules.
The driver may be allowed to post bail depending on the decision of the court.
The family of the victim can also file a civil case to claim compensation for funeral expenses, loss of income, or moral damages.
If the investigation proves the driver was not negligent and the incident was purely accidental, the driver may be released without charges, but this will depend on the findings of the police and the court’s judgment.
