Tragic Accident: motorcycle rider dies after hitting dog and crashing into bus

A motorcycle rider died after being hit by an oncoming passenger bus.

The incident took place along the national road in Siaton, Negros Oriental.

As shown in a video shared by GMA 7's '24 Oras Weekend,' the motorcycle rider struck a dog that reportedly crossed the road unexpectedly.

The impact caused the rider to lose control of his motorcycle, veer into the opposite lane, and collide with an oncoming passenger bus.

The 37-year-old victim was pronounced dead on arrival at the hospital.

According to the authorities, the passenger bus was running at normal speed, however, the motorcycle, given the circumstance, invaded the opposite lane, resulting in the tragic incident.

The bus driver turned himself in to the authorities and is now detained in Siaton Police Station.

Investigations about the incident are still ongoing. Meanwhile, what happened to the dog wasn't reported yet.

In the Philippines, if a driver accidentally kills another motorist and then willingly surrenders to the police before being arrested, the act of surrendering can serve as a mitigating circumstance under Article 13 of the Revised Penal Code.

Voluntary surrender must be spontaneous, made to a person in authority, and occur before any arrest has been initiated .

When these conditions are met, the court may reduce the penalty one degree lower than the prescribed range, or impose the minimum period within that range, depending on whether the offense carries a divisible or indivisible penalty .

For instance, in hom!cide cases involving voluntary surrender and no aggravating factors, the penalty is imposed at the minimum level under Article 64 .

Therefore, a driver who accidentally causes a death and surrenders before arrest can receive a lighter sentence, assuming no other aggravating circumstances are involved.

However, the final decision rests on the court’s discretion and the specific circumstances of the case.
