A truck collided with a motorcycle, resulting in one fatality and another person injured.

The accident took place in Barangay Bacayan, Cebu City, on Saturday morning.

Captured on video and shared by ABS-CBN's 'TV Patrol Weekend,' the motorcycle and the truck were seen traveling on the same lane.

Suddenly, the truck moved forward and struck the motorcycle.

The truck went straight into the road gutter, while both the motorcycle rider and its backrider were thrown under the truck, according to the Traffic Enforcement Unit of Cebu City Police.

The motorcycle rider was even rushed to the hospital for immediate medical attention, but was declared dead on arrival.

Meanwhile, the backrider is now safe and just recovering in the hospital.

The truck driver is already in police custody, and he will be charged with reckless imprudence resulting in hom!cide and damage to property.

In the Philippines, reckless imprudence resulting in hom!cide and damage to property is a criminal offense under Article 365 of the Revised Penal Code.

It refers to a situation where a person, through negligence or lack of proper care, causes the death of another person and damage to property.

This is not considered intentional, but the act shows a disregard for safety or failure to take necessary precautions.

For example, a driver who overspeeds or ignores traffic rules and ends up causing a fatal accident may be charged with this offense.

The penalties depend on the outcome of the incident, such as the number of people killed, the extent of property damage, and any aggravating circumstances.

This crime is punishable by imprisonment or a fine, and the offender may also be required to pay civil damages to the victims or their families.
