Meanwhile, the tricycle driver eventually died while being treated in the hospital.
The families of the victims and the bus company have already agreed to a settlement.
In the Philippines, a settlement is possible between the suspect and the victims or their families in a road incident, even if there were casualties.
However, there are important things to consider. The parties can settle the civil aspect, which usually includes financial compensation for damages, hospital bills, burial costs, and other losses.
If the case involves criminal charges like reckless imprudence resulting in hom!cide, a settlement does not automatically erase the criminal liability.
But it can help lessen the penalty or sometimes lead to dismissal if the court sees fit and the offended party no longer wishes to pursue the case.
Any settlement must still be presented to and approved by the court, especially if there is a formal case filed. It is the judge who decides whether to allow it or not.
If the incident was purely accidental and without intent to harm, courts are usually more open to considering settlements.
But if gross negligence or intent is involved, it becomes harder to settle the case privately.
