The 30-year-old woman (backride) died from the incident while the driver was in the hospital for recovery.
Investigations are still ongoing about the incident.
In the Philippines, a motorcycle driver involved in an accident that results in the death of a passenger may face penalties depending on the circumstances.
If the driver is found negligent, such as overspeeding or drunk driving, they can be charged with reckless imprudence resulting in homicide, which carries imprisonment of up to six years, fines, and civil liability.
If the accident was due to traffic violations like running a red light or illegal overtaking, additional penalties may apply, but if it was purely accidental, the driver may not face criminal charges, though civil liability could still be required.
In cases where the motorcycle is insured, the insurance company may compensate the victim’s family, sometimes leading to a settlement instead of criminal prosecution.
