The Sandiganbayan has dismissed the forfeiture case filed by the government against former President Ferdinand Marcos, Sr., former First Lady Imelda Marcos, and a certain Roman Cruz, allegedly a crony.

In its decision, the 2nd Division of the Sandiganbayan granted the motion to dismiss filed by the former President Marcos’ estate and Mrs. Imelda Marcos.

In a report published by News5, it quoted the court as saying that it decided to grant the motion because of “inordinate delay.”

“They can no longer be afforded a fair trial since the witnesses may have already died and the documentary evidence may no longer be located after more than 30 years from the filing of the complaint,” News5, quoting the Sandiganbayan decision, stated.

“Considering that the extant living defendant is 95 years old, her ability to testify and recall the events has assuredly declined, as has her health,” it added.

According to a Philippine Star report, the case involved P276-million claim of the Presidential Commission on Good Government (PCGG) against the Marcos estate.

In a report by Rappler, PCGG filed the case almost 40 years ago, or to be exact on July 21, 1987.

The government agency sought the forfeiture of P276 million worth of properties from the Marcoses, as well as a P50-billion award in moral damages and P1 billion in exemplary damages.
