TV host and actor Vic Sotto testified on Tuesday in a Muntinlupa court over the cyber libel case he filed against director Darryl Yap.

According to Sotto’s lawyer, Atty. Enrique Dela Cruz, the actor gave his statement about the alleged malice on Yap’s side in making a film about the late Pepsi Paloma, which seemed to suggest that Sotto raped her.

The case started after the teaser of Yap’s upcoming film The Rapists of Pepsi Paloma was shown last January.

In the teaser, actress Gina Alajar, playing Charito Solis, asked the character of Pepsi Paloma if Vic Sotto raped her.

The actress who played Pepsi answered yes.

Sotto clarified in his sworn statement that the teaser shortened the scene and gave the wrong impression.

He also said in an earlier hearing that Yap himself admitted Sotto was not named in the film as one of the rapists.

His lawyer added that the movie script stated the controversy was only a publicity stunt, but this part was not included in the teaser video.

Yap’s camp refused to give any comment. He is facing charges under Articles 353 and 355 of the Revised Penal Code, linked to the Cybercrime Prevention Act of 2012. The director already entered a not guilty plea.

The court has set the next hearing for September 9.

Pepsi Paloma, whose real name was Delia Smith, was a former sexy actress who died in 1985 at the age of 18.

In a previous report by KAMI, Darryl Yap posted on social media after Vic Sotto filed a complaint against his film, which was said to be based on the real-life story of Pepsi Paloma. Yap stressed that everyone has the right to file a complaint in pursuit of truth and justice. His post also included a screengrab from the movie teaser that showed the controversial subtitle “oo.” He emphasized that they would return to court to once again discuss the issue connected to Pepsi Paloma.

In addition, the controversial director was also involved in an online spat between social media personalities Chloe San Jose and Sophia Delas Alas, daughter of Ai-Ai Delas Alas. In a post that quickly went viral, Yap jokingly said that he also wanted to join the feud, writing, “Include me in your fight. I’m brave enough too.”
