As reported by GMA News Online (author Amita Legaspi), it was Senator Risa Hontiveros who authored the Senate Bill 2134.

What is Divorce Act of 2018?

As stated in the bill, divorce is defined as the legal cancellation of marriage by the court through a legal procedure. It requires a petition for divorce by one party.

Once granted, both parties will be given the status of being single, as well as the right to remarry.

What are the grounds for divorce?

  • Psychological incapacity
  • Violation against Violence Against Women and their Children Act
  • Irreconcilable differences
  • When the spouses have been separated for at least 5 years and reconciliation is highly improbable

Penalties or fines

Those found guilty of using fraud, force, or intimidation to push their spouse to file for divorce will be given a fine of P200,000 and jail time for 5 years.

Any parent who will not provide child support or any spouse who will not pay the alimony will be fined P100,000 to not more than P300,000 on top of the unpaid child support and/or alimony.
