The Sandiganbayan’s anti-graft court announced that the prosecution presented sufficient evidence to produce a warrant to convict former Senator Jinggoy Estrada and businesswoman Janet Lim Napoles.
KAMI learned that the Sandiganbayan 5th Division has denied the demurrer to evidence filed by Estrada and Napoles.
In a report by GMA News (author Joseph Tristan Roxas), a demurrer is a motion that seeks to dismiss a case due to weak evidence.
"This court is convinced that the prosecution presented sufficient evidence, both testimonial and documentary, which established each element of the crime of plunder against the accused," the Sandiganbayan said.
"This, if unrebutted by contrary evidence, is sufficient to support a conviction for the crime as charged," it added,
As reported by the ABS-CBN News (author Adrian Ayalin), Estrada and Napoles are expected to show their own evidence and give testimonies to prove their innocence.
Estrada and Napoles were accused of graft and plunder after they allegedly misused the Priority Development Assistance Funds (PDAF) or the “pork barrel.”
KAMI reported before that Estrada still joined the Senatorial race despite the charges he was facing. However, he was not able to make it to the top 12 and conceded his defeat.
