President Rodrigo Duterte has recently signed into law a bill seeking to lessen the complication and cost of the legal adoption process.
KAMI learned that on February 21, 2019, President Duterte signed the Republic Act 11222 or the Simulated Birth Rectification Act.
In a report by the Manila Bulletin, “birth simulation” is the process of altering the civil registry to make it appear as if a child was born to a certain person even if that person was not the biological mother.
According to the new measure, the process will include filing a petition in a form of affidavit to be submitted to the Social Welfare and Development Officer (SWDO) of the city where the child lives in. The Secretary of the Department of Social Welfare and Development (DSWD) will be given 30 days to review the petition.
According to a report by the ABS-CBN News, there should be written consent by the adoptee, illegitimate and legitimate child when he or she is 10 years old and above.
Once the process has been done, the adopted child will be considered as a legitimate son or daughter and will be entitled to all the rights and obligations provided by the adopter.
