13 Asian countries and their age of criminal responsibility

The House of Representatives has recently approved the bill seeking to lower the age of criminal responsibility to 9 years old. However, not every Filipinos agreed with it even some senators and local celebrities disagreed with it.

In a report by ABS-CBN News, KAMI learned that 13 Asian countries have different age of criminal responsibility. Some has set it to children as young as 7 years old. Meanwhile, others had set it to 15 years old.

Here are the age of criminal responsibility of 13 Asian countries:

Thailand

Thailand has set their age of criminality for children older than 7 years old. However, the children will not be punished until they reach 14 years old.

Singapore

In Singapore, the age of criminal responsibility is at 7 years old. For those child offenders aged 16-17, they are tried as adults.

Myanmar

Myanmar’s Child Law indicates that children above 7 to 12 years old will only be held criminally liable if they reach that sufficient maturity of understanding to know the nature and consequences of their actions.

Brunei

According to the Brunei Penal Code, the age of criminal responsibility is from 7 to 12 years old only if they have reached sufficient maturity of understanding to know the nature and consequences of their offense.

Indonesia

In Indonesia, children aged 8 years old can be criminally responsible. But their new law increased it from 8 to 12 years old.

Malaysia

Malaysia has set their age of criminal responsibility to 10 years old. However, there is a law that children can be held liable from the onset of their puberty.

Hong Kong

In Hong Kong, the age of criminal liability is at 10 years old. However, the juvenile court has the jurisdiction to hear the offense linked to the child.

Cambodia

The age of criminal responsibility in Cambodia is at 14 years old. The child offenders are considered as adults and mixed with them in detention. However, they are trying to address this issue.

Japan

Japan has set their age of criminal responsibility at 14 years old. It is also the minimum age that a child can be detained while the investigation is on-going.

South Korea

In South Korea, the age of criminal liability is set at 14 years old but they are trying to lower it at 13 years old.

Vietnam

The age of criminally responsibility in Vietnam is at 14 years old. The child offenders are criminally responsible at the age of 14 and up while 16 years old and older are liable for any criminal offense.

China

According to the Criminal Law of the People’s Republic of China has set the age of criminal responsibility at the age of 14 to 16 years old. Children aged 14 who committed serious crimes can be criminally responsible.

Laos

In Laos, children who are below 15 years old are not criminally responsible.

In a previous report by KAMI, the senator commented regarding their opinion on the recently approved proposed law. Many senators disagreed with this bill.
