AFP Chief Galvez, kinumpirma ang pag-apply ng amnestiya ni Senador Trillanes

- Kinumpirma ni AFP Chief Carlito Galvez Jr. na nag-apply ng amnestiya si Senator Trillanes

- Base raw ito sa dating head ng amnesty committee na si Col. Josefa Berbigal

- Nanindigan naman ang Palasyo na wala pa rin namang pruweba ang kampo ni Trillanes dito

Hanggang sa ngayon ay hindi pa rin mahanap ng Armed Forces of the Philippines (AFP) at Department of National Defense (DND) ang mga dokumentong magpapatunay na nag-apply nga si Senador Antonio Trillanes ng amnestiya noong 2010.

Habang nasa budget hearing ay naisingit namang tanungin ni Senador Trillanes sina Defense Secretary Delfin Lorenzana at AFP Chief of Staff Gen. Carlito Galvez Jr. kung nag-apply ba siya ng amnesty.

Nalaman naman ng KAMI na sabi ni Galvez ay “There were some lapses na hindi naibaba 'yung documents sa J1, which was the repository of documents kasama 'yung oath. 'Yung ano namin, 'yung papers were not brought down.”

Sabi ni Trillanes, “So nag-apply ako, sir?”

Sagot naman ni Galvez ay “According to Berbigal, sir, yes.”

Si Col. Josefa Berbigal ang dating head ng amnesty committee secretariat noon. Nagbigay na rin ng affidavit si Berbigal na nag-apply at kumpleto ang requirements ng senador noon at siya mismo ang nagprocess nito.

Giit naman ni Lorenzana na wala siya sa posisyon upang sagutin ang tanong dahil nangyari ang application noong nakaraang administrasyon. Ngunit diniin naman ni Lorenzana na nagsulat diumano si Solicitor General Jose Calida sa AFP general headquarters ukol sa mga records na may kinalaman sa application nga ni Trillanes.

Diin naman ng Palasyo, hangga’t wala ang mga documents ay mananatiling invalid ang amnesty ni Trillanes.

Ayon kay Presidential Spokesperson Harry Roque, “He [Trillanes] applied for amnesty? Well, there’s visual that he applied for amnesty, but the question is: where is the form? It all boils down to ‘where is the form’ and the form is all important because the form contains the admission of guilt, which is a sine qua non requirement for grant of amnesty.”

“Unfortunately, we are governed with the rules of evidence, best evidence rule, you have to prove first and foremost why you cannot produce the original document. He [Trillanes] is unable to produce it,” dagdag niya pa base sa report ng Philippine Star.

Para naman kay Presidential chief legal counsel Atty. Salvador Panelo, “"That will not erase the fact that as far as the records are concerned, there is none,"

"Let's just wait for the courts to decide whether indeed or not there was a grant of amnesty and the mandatory requirements for that have been complied with," sabi ni Panelo base sa report ng ABS-CBN News.

Sa darating na October 5, 2018 naman ang hearing ng Makati City regional trial court (RTC) Branch 150 kung saan nakahain ang kasong coup d’etat ni Senador Trillanes.
