Senator Jinggoy Estrada’s two separate motions to leave his detention this month was denied by the Sandiganbayan Fifth Division.
The Sandiganbayan explained that Jinggoy’s mother – Loi Estrada – can go to her son in Camp Crame to celebrate her birthday party with family and friends instead of the other way around.
“It will be a mockery of the justice system if Senator Estrada be allowed, at his whim, or that of his family, to attend his mother’s birthday celebration that can nonetheless be held or celebrated within his proximity,” the Fifth Division said.
The Sandiganbayan added that it will only allow Estrada to leave his detention for emergency matters such as the necessity for a hospital healthcare service.
“As this Court has long adverted, only emergency or compelling temporary leaves from imprisonment are allowed to all prisoners at the discretion of the authorities or upon court orders,” the court stated.
Jinggoy’s cell is located at Philippine National Police (PNP) Custodial Center in Camp Crame. He is being detained due to plunder and graft charges connected to being allegedly involved in a P10 billion pork barrel scam along with senators Juan Ponce Enrile and Bong Revilla.
Estrada’s first motion filed last week was to request a leave from detention from 8 p.m. to 12 midnight on Saturday, June 4 in order to attend a thanksgiving Mass and dinner for his mother at 409 Shaw Boulevard, Mandaluyong City.
The senator’s second motion filed on May 23 was to request a leave from detention on June 6 to 8 in order to attend the Senate’s final session days and to remove from his Senate office all of his business and personal effects.
However, the Sandiganbayan reminded Estrada that his right to practice his duties as a senator was automatically extinguished due to his detention.
