Nadine Lustre remains calm even after the Viva Artists Agency (VAA) filed a breach of contract suit against her.
The filed lawsuit emerged after the performer-actress decided to terminate the management contract with the entertainment agency in January this year.
According to Nadine’s legal counsel, Atty. Lorna Kapunan, they are in no doubt that the truth about Viva’s oppression towards their talents, not just Nadine, will come out. She accused the agency of taking advantage of its young talents.
Atty. Kapunan’s statement came on Friday night, December 11, right after Viva announced the filed complaint before the Quezon City Regional Trial Court.
Viva accused Lustre of unilaterally terminating her management contract and disregarded its exclusivity. She allegedly independently transacted with third parties, such as advertisers and promoters.
According to Viva, Lustre is expected to stay as their exclusive artist until June 2029, based on their contractual agreements.
However, Kapunan contested the agency’s stand. Furthermore, she insisted that it is Viva that must be sued for a breach of contract.
Kapunan added that they can prove that it is Viva that violated its contract with Nadine. According to her, they can also show that the entertainment group has been guilty of “tortious third-party interference”. It resorted to pressuring third parties that deal with the actress in good faith and intimidated them with threats of possible court cases.
Nadine’s lawyer also cited the actress’s activities since the beginning of 2020, which were all independent from Viva.
According to her, the "On the Wings of Love" star is currently self-managing and has the right to do so, especially with the ongoing pandemic. She has the right to keep earning without the need to pay for agency fees, which according to the lawyer, Viva does not deserve.
Atty. Kapunan continued to say that the issue is not only Nadine's fight, but it is for the other artists who face the same situation.
The said conflict between Nadine and Viva started when the actress's camp announced that she would begin managing her own career. They cited Article 1920 of the Civil Code, which is their basis for revoking the agency even if under a contract. On the other hand, Viva disputed this claim and stated that Nadine cannot unilaterally step out of the deal.
Nadine has been under Viva's management since 2009. The agency accused her of choosing to disregard and violate their contact despite having a successful career being their exclusive artist for nearly a decade.
Nadine Lustre is a Filipina, singer, actress, and music video director. She was once part of the all-female group, Pop Girls. Her popularity started when she starred in “Diary ng Panget” opposite James Reid.
Currently, Nadine is part of James Reid’s record label, Careless music, and remains with the ABS-CBN. Recently, she released a new single under Careless Music. Also, Nadine, together with James and Angel Locsin went trending after they were seen altogether wearing the “Ikaw ang Liwanag at Ligaya” shirt during the taping for the Kapamilya Network’s station ID.
